Compensation for slips and trips in nightclubs

So you’re out with friends on a Saturday night, on the dance floor, when all of a sudden you slip and lose your balance, crashing to the floor and potentially suffering a very nasty injury.

At some time or other, most of us have fallen over in a bar or a nightclub, usually as a result of having a few too many drinks.  But where a slip, trip or fall was caused by the negligence of the nightclub or its staff, it may be possible to bring a claim against the club for personal injury compensation.

You might not realise it, but all nightclubs owe a duty of care to their customers, to allow them to use the premises without being injured, and to take reasonable steps to prevent people from being injured.  One area where this duty of care is particularly important in the case of nightclubs is when it comes to dealing with spilled liquids on the floor of the club, which might prove a slipping hazard to their customers.

Whilst it might not be practical in the middle of a busy nightclub to mop up all drink spills immediately, all nightclubs should have in place a system for regular inspections of all areas open to the public.  A system like this allows the staff to quickly remove any hazards such as broken glass or spills from the floor of the club, which minimises the chances of anyone falling over and being injured.

    I slipped over on a dancefloor on a night out and banged my face and sprained my hand.

    I still have a black eye 3 weeks later and feel I may have damaged my cheek bone.

    Do I have a case?

    According to me : If the accident isn’t 100% your fault, you are entitled to make a slips and trips injury claim, however, you need to ensure you receive the best advice about how to make your claim, otherwise you may not receive what you are entitled to.

    I slipped over on the dance floor in a club because people spill their drinks and didn’t see it and broke my foot and haven’t been able to work.

    My partner was on the dancefloor in a nightclub and had a glass bottle thrown over at his head, unprovoked and we think it was accidental. However, the club shouldn’t have had glass bottles on the dancefloor. Do you think we have a case?

    My friend slipped on a wet floor in a nightclub causing a very swollen ankle which was extremely painful. The fall meant she actually fell over and had to be helped up by a passer by. Following where she slipped in the exact same spot a bouncer also slipped 5 mins after. We logged a fall report with the manager, on the way out we asked for the name of a bouncer who was standing near where it happened for his name which he refused to give us. There are cameras where it happened so they should have the fall recorded. Does she have a claim?

    Yes I was recently at a nightclub and had VIP the bartenders had brought the wine and shots out. It was very wet on the table from ice and everything. At this nightclub they have the stripper poles in the middle. A friend and I were dancing and I didn’t know that the guy who took the glasses away and wiped down the floor did not wipe down the table for dancing. I was dancing and slipped or fell backwards. In the process my knee made a really loud snap sound. I could not walk or put pressure on it – went to the doctor after I got home and found out my Lateral Collateral Ligament had torn in my right knee do I have a case?

When it comes to spills on nightclub floors, you would have to look at what procedures where in place to mop up these spills and whether these procedures had been followed at the time of your accident. If you had slipped over on liquid that had been spilled only moments before it would be difficult to argue that the nightclub could have done anything more to prevent your injury. However if the spill had been around for some time and the staff of the club had been made aware of it, then you may have a stronger case.     Hi, I was in a night club and didnt see glass one the floor, i realised i stood on some glass which went through my shoe and into my foot. I was taken to A+E and had an xray, lucky enough i did not need stitches but i did loose alot of blood at the night club. Do i have a case?

    I was recently at a night club and glass that was on the floor went into my shoe and straight into my foot. There was loads of blood then an ambulance was called, i had no stitches but an x ray and pain killers? Do i have a cliam?

    It is definitely the case that night clubs ought to have a safe system in place to avoid accidents like these occuring. However, due to the fact that the injured party was very likely to have consumed alcohol is there a question of contributory negligence? Surely there shouldn’t be since drinking should be considered a very normal activity at a nightclub thus the clubs themselves should be expected to take extra precautions.

    Would I have a claim. I was in a club about 5years ago and fell down a flight of stairs I was knocked out as at the bottom of the flight of stairs was a cigarette machine with a curved metal bit on it. The stairs were wet from drink etc.

    I was rushed to a&e and had 8 stitches in my face, from the end of my eye brow and around my eye. I had a minor fracture in my cheekbone.

    I still have the scarring and a big dent in my cheekbone which still hurts.

    The club owner no longer owns the club but could easy get details. He was aware of the incident as he removed the cigarette machine shortly after. The staff there rang the ambulance and I spoke to him the week after, he was very very worried when I did. There was CCTV of the accident but doubt there is now

    Prob too late for a claim now?

You normally have 3 years from when you sustained your injury to make your claim. If you were under 18 at the time of the accident, then the 3 years do not start to run until your 18th birthday.

    I had fallen down some outside stairs that the club uses as a smoking area and the best route from going from 1 floor to enough. The accident happened on new years day the stairs was wet and I slipped down them and have hurt my arm that the hospitial calls muscle damage. There was plenty of people around but I dont know if they would help as witnesses as they might of been drunk. Could I have a claim?

    Two nights ago I slipped down a flight of stairs in a nightclub and broke my ankle. The stairs are carpet but have metal edging on them, this is how I slipped. The club floor is constantly swimming in drinks that are dropped and I’m not sure they clean it until the end of the night. After slipping I hobbled to a seat where the bouncers told me I had to leave and wouldn’t even help me outside. What are the chances of having a sucessful claim, I don’t think the club would provide the cctv.

    I slipped on a spilled drink on the dance floor, smashed to the floor landing on my left shoulder and right knee.

    Luckily, I have only damaged the cartilage in my shoulder, but I was close to fracturing my collar bone.

    The bouncer just kept screaming GET UP at me, although I was in a lot of pain. Didn’t take me to first aid or anything!
